Protecting your personal data matters to us. This privacy policy explains which personal data we process when you visit our website www.mnt.capital (the "Website"), for which purposes, on which legal basis, and what rights you have. It is based on the EU General Data Protection Regulation ("GDPR"), the German Federal Data Protection Act ("BDSG") and the German Telecommunications Digital Services Data Protection Act ("TDDDG").

The Website is purely informational. MINT Capital is a private, invite-only investment vehicle, and the Website is aimed at persons who have been referred to us. We do not offer user accounts, newsletters, contact forms, online registrations or any online transactions on the Website. We do not use analytics, advertising or tracking tools.

2. Controller

The controller within the meaning of Art. 4(7) GDPR is:

MINT Capital GmbH & Co. KG, Himmelstrasse 15, 22299 Hamburg, Germany

Represented by: Jan Marius Marquardt, Waldemar Wacker

Email: contact@mnt.capital

We have not appointed a data protection officer, as we are not legally required to do so. For all questions about data protection, please contact us at the address above.

3. Hosting and server log files

The Website is hosted by Webflow, Inc., 398 11th Street, 2nd Floor, San Francisco, CA 94103, USA ("Webflow"). Webflow provides the platform on which the Website is built and delivers it to your browser, including through content delivery networks and the infrastructure of its sub-processors.

When you visit the Website, your browser automatically transmits data that is technically required to deliver the pages and to ensure security and stability. This data is processed in server log files and typically includes:

  • IP address of the requesting device
  • date and time of the request
  • requested page or file and the amount of data transferred
  • HTTP status code
  • referrer URL (the page you visited before)
  • browser type and version, operating system and device information (user agent)

‍

Purpose: Delivering the Website, ensuring its technical security, stability and integrity, detecting and defending against attacks and misuse.

Legal basis: Art. 6(1)(f) GDPR (legitimate interest). Our legitimate interest lies in the secure and error-free operation of the Website.

Storage duration: Log data is stored only as long as necessary for these purposes and is then deleted or anonymised, in accordance with Webflow's retention practices.

Data processing agreement: We have concluded a data processing agreement with Webflow in accordance with Art. 28 GDPR.

Third-country transfer: Webflow is based in the USA, so personal data may be transferred to the USA. The transfer is safeguarded by the European Commission's adequacy decision for the EU–US Data Privacy Framework, to the extent Webflow is certified under it, and otherwise by the EU Standard Contractual Clauses pursuant to Art. 46(2)(c) GDPR.

4. Google Fonts

To display text in a consistent and appealing way, the Website uses fonts provided by Google Fonts. When you open a page, your browser loads the required fonts from servers of Google, which means your browser connects to Google servers and transmits technical data, in particular your IP address, the requested font resources, browser and device information and the referrer URL.

The provider of Google Fonts is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google may transfer data to its parent company Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Transfers to the USA are safeguarded by the EU–US Data Privacy Framework (Google LLC is certified) and, where applicable, Standard Contractual Clauses.

We do not use any other Google services on the Website, and we do not use Google Fonts to identify you or to build user profiles. We have no influence over any further processing of the transmitted data by Google.

Purpose: Uniform and visually appealing presentation of the Website.

Legal basis: Art. 6(1)(f) GDPR (legitimate interest in an attractive and consistent presentation of our online offering). You have the right to object at any time (see Section 9). If your browser does not support web fonts, a default font of your device is used.

5. Cookies and similar technologies

We do not use cookies or similar technologies for analytics, marketing, reach measurement or profiling. We therefore do not display a cookie consent banner. To the extent technically necessary information is stored on or read from your device in order to deliver the Website (for example by our hosting provider), this is done on the basis of § 25(2) No. 2 TDDDG, and any related processing of personal data is based on Art. 6(1)(f) GDPR.

You can configure your browser to inform you about cookies, to accept them only in individual cases, or to reject them in general. Please note that this may limit the functionality of some websites.

6. Contact by email

If you contact us by email at contact@mnt.capital, we process the data you provide (such as your name, email address, the content of your message and any other information you share) in order to handle your enquiry and to communicate with you.

Legal basis: Art. 6(1)(b) GDPR where your enquiry relates to a (pre-)contractual relationship, for example an interest in becoming an investor, and otherwise Art. 6(1)(f) GDPR (our legitimate interest in responding to enquiries). Where we are legally required to retain or verify information, for example under anti-money-laundering or commercial and tax law, the basis is Art. 6(1)(c) GDPR.

Storage duration: We delete your data once your enquiry has been fully handled and no statutory retention obligations apply. Where a business relationship results, we retain data for as long as needed for that relationship and the statutory retention periods (in particular under Section 257 of the German Commercial Code (HGB) and Section 147 of the German Fiscal Code (AO), generally six to ten years).

Please note that email communication may be insecure. We therefore recommend that you do not send particularly sensitive information by unencrypted email.

If and when we process data of investors in a later onboarding process (for example identification and due-diligence data), we will inform you separately in accordance with Art. 13 and 14 GDPR.

7. Recipients of data

We pass personal data to third parties only where this is necessary for the purposes described above or where we are legally obliged to do so. Recipients may be:

We do not sell your personal data.

8. Transfers to third countries

Personal data is transferred to countries outside the European Economic Area (in particular the USA) only where this is permitted under Chapter V GDPR, i.e. on the basis of an adequacy decision of the European Commission or appropriate safeguards such as Standard Contractual Clauses. You can request a copy of the safeguards used by contacting us.

9. Your rights

You have the following rights with regard to your personal data:

  • Right of access (Art. 15 GDPR): confirmation of whether we process your data and information about that processing and a copy of the data.
  • Right to rectification (Art. 16 GDPR): correction of inaccurate or incomplete data.
  • Right to erasure (Art. 17 GDPR): deletion of your data where the statutory requirements are met.

  • Right to object (Art. 21 GDPR): you may object at any time, on grounds relating to your particular situation, to processing based on Art. 6(1)(f) GDPR. We will then stop the processing unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

To exercise your rights, simply send us an email to contact@mnt.capital.

10. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), in particular in the Member State of your habitual residence, place of work or place of the alleged infringement. The supervisory authority responsible for us is:
